What Does a Guardianship Mean?

There are two types of guardianships: guardianships of persons and guardianships of property (also known as conservatorship). Each is given the power to make certain types of decisions. You can choose one person to perform both tasks, or you can choose to split these duties between two people.

When you name someone to be the guardian for yourself or for a minor child — you are trusting another human being to answer the most basic and essential types of life questions for you, including questions such as where you should live or which doctor you should see for health care needs. By contrast, a conservator's primary function is to take care of financial affairs and property. In either case, these basic facts are important to keep in mind when considering your choice.

Obtaining Guardianship of Adults

If you are concerned about a loved one who you believe is no longer able to take care of themselves (e.g., an aging parent, a vulnerable adult child or an incapacitated sibling) — our lawyers can assist you in obtaining a court's permission to serve as guardian while avoiding the common mistakes that so often lead to having guardianships disputed, denied or rescinded.
